Right of abode

Post by wenner » Thu Aug 02, 2012 12:36 pm

Dear All
I hope that there is a kind soul that can give advice or share his/her experience.

I am due ILR on 3rd Oct 2012.Once I have ILR, I want to register my daughter, who is in South Africa at moment, as a British citizen.I am now able to send the application from the UK, even though my daughter is in South Africa.I have a few queries:
1.Do I need to submit her South African passport when I register her as a British Citizen or is it acceptable just to submit her Full Uk Birth Certificate and my details?(I want to make application under sec 1(3))

2.Do I need to be in South africa to apply for her British passport or can I make the application from here and send it to UK Embassy in SA?

3.If I cant apply for passport from here, can my father make the application?(My daughter is in care of my parents at moment)

4.If 2 and 3 is not possible, can I apply for my daughter's certifcate of entitlement to Right to Abode in South Africa or UK?

5.Does anyone know how long the application process for Right of Abode takes?I cannot find answer on UKBA or anywhere else.

Please, any advice will be much appreciated!
thanks

it has been days.I really thought somebody would have responded by now.In the mean time, I am looking for answers myself, on UKBA.It is not always very clear, and sometimes confusing. This is why I wanted to know if there is someone who has experience applying for their children's British Citizenship and passport from overseas before.Or is my situation unique?

1. An applicant for s1(3) registration does not need to have a passport.

2 & 3. Are you asking about s1(3) citizenship application or passport application?

4 & 5. If your daughter becomes a British citizen do you want her to have a British passport or a Right of Abode stamp in South African passport? She can't have both.

Hi

I Was also in the similar situation.

My child was born here and spent his first 18 months in UK but now residing in home country with my wife due to health complications. I was granted ILR recently and want to register my child under section 1(3). I went through MN1 guide and have few questions.

1. UKBA, recently changed the rules of where to send the form, and now I can directly post to Liverpool, does it means all I need is my child's full birth certificate and proof of my ILR or do I need his current passport or any other supporting documents?

2. Also can I use my UK address for the registration certificate to be posted or it must be the child's current address abroad? If it is later, where does that registration certificate will be sent to?(to child's residence or local consulate?)

3.My child is well known to GP, Health Visitor and many medical professionals here in UK, because most of the time child spent in hospital due to health complications. Can I ask any of these professionals to sign as referee or it must be from professionals from abroad, since his most recent stay is not UK ?

I will be grateful, if someone can help me with information? Wenner How were you planning to sending the application from uk, referees etc?

Rivercam, I am not sure about referee's yet.I am thinking of asking our family doctor in south africa.I have few friends who have British passports here in the Uk, so I will ask one of them, because they knew her while she was in the UK.I have photographs to show that they knew her, and I will submit these as well. Not sure if it will work, really dont. When I am ready to apply, I will find out.

JAJ.
I want to apply for my daughter's British passport so that she can travel from south africa back to the Uk.This is why I asked, can I apply from here and send the application for british passport to Uk embassy in South africa. If I cant do that, can my father apply on my behalf(for her british passport), since I am here in the UK?
If that is not possible, can I apply for her right of abode?I know she cant have both,I am just anxious to get her back, and looking at all the different options available to me.
I went to South Africa while on maternity leave, and I applied for her dependency visa but it was refused because her father doesnt have permission to be in UK.her father, my husband's dependency visa was refused as well, because of his previous immigration history.I hope that this wont ruin her chances of getting a British passport, but it shouldn't, because luckily she was born here, and therefore, entitled to be registered as a British Citizen. But then again, you never know. After this year, so many failed applications, I just know, they dont seem fair.JAJ, I hope my questions are clearer now, and that you will be able to give me some advice.Thanx.
