FLR(M) - Version 2 for applications after 30th July 2012

Hi,

Just be aware that HO has published a new version of FLR(M)V2 \ Guidance Notes which will be applicable after 30th July 2012 & I am going to apply for FLR(M) for my wife on 6th August as she is in UK since last 20 months on Tier(1) dependent.

As per guidance notes, page 5 section d "You need to meet the financial requirement if you made your first application to enter or remain here as a partner after 9th July 2012."

My Question is regarding section 7A - 7.1
"Are you or your sponsor in receipt of a benefit listed within the guidance notes? If you claim to be exempt from meeting the financial requirement you must submit the relevant evidence, as specified, of your eligibility to be exempt"

As my salary is > 25,000 so what should I select Yes or No

Well if you are receiving any benefits listed in the guidance note then you should tick yes otherwise no.

PS - You may not fall under the new financial requirements for FLR, what is your current VISA status? are you here as a dependent of someone i.e. Teri 1, PBS etc?

You may need to show slightly different documents for either categories.

I am currently of Tier1 visa & going to apply for ILR on 6th August morning.

Same day afternoon, I have booked appointment for my wife FLR(M) as she is in UK as T1 dependent since last 20 months (4 months short to complete 2 year).

As you come under the old rules for FLR, you would need to show that you meet the financial requirements.

The requirements are to have equivalent amount as someone on Income Support per week after paying Council tax and rent.

I think the amount is somewhere around £120 per week left after paying Council tax and rent.

Since your salary is above £25K you should be fine to show most relevant documents i.e. Payslips, Council Tax document, Bank statements (showing incomings and outgoings). Plus all other documents as relate to your employment i.e. P60, employment contract, reference letter from the employer etc. would be helpful as well.

Hi,

I suggest you to book at least next day appointment for your wife ,
Very few people got their ILR IN half a day time. most of us were waiting till evening and heard the same story of system Problem.

If Papers are not processed on the same day, it is considered as good as Postal application.

Your chances of winning or losing fee is 50:50.

Not to scare you , want to inform you....

Pls do update your status one done.

I'm in the same position as you are except I have already got my ilr few weeks back and looking to apply for an extension for wife as she has not completed 2 years to get ilr.

This new form has not many changes, it has one additional requirement in

7.1A Is your sponsor a serving member of the HM Forces?

7.3 From the list below, please indicate the financial source(s) and the amount of income you and/or your sponsor
wish to rely on to meet the financial requirement
Income from salaried employment - Complete Section 7.3A Current annual salary ( CURRENT ANNUAL SALARY IS MADE CLEAR IN NEW FORM)

The new form was made in Hurry burry to implement new rules on July 9th 2012.

Alle - I got my ILR & then I discussed about my wife visa status & which form she should fill. Casework was confused & not sure so I didn't discuss with her.

Then we went for our turn for FLR(M) for my wife & unfortunately the same care worker was there & she was confused which form my wife should fill. I gave her FLR(M). She went & discussed with other case workers but was not sure.

Then she gave printed a new FLR(O) form & ask me to submit both of them as she was not sure.

At the end, she said that she is approving our FLR(O) form & granted 5 months visa for my wife as she is 5 months short to complete 2 years in UK.

On FLR(O) form - We filled other categories & put the reason that we have completed 18 months on PBS dependent & reason for extension is to complete 2 years.

So at the end , my wife is granted leave on FLR(O) form for 5 months. It was all very confusing but now she can apply for Indefinate in December on SET(M).

I bet it is confusing and I'd appreciate if you could give me a ring tonight


My main concern is what documents are they looking for under this form, particularly around financial requirements etc. It would really be helpful if you call me cos its a very new thing and very few people have any knowledge about this

Congrats !.. You have been very lucky. I have send my FLR(M) by Post for want of additional 5 months period.
