You would need to prove that the Cape Town certificate of education is equivalent to or above a UK bachelor's degree. If you cannot, or are unsure that you can, it would be best to take the English test, it wouldn't be any problem for you. The quickest one is Pearson (PTE Academic), it costs about £120, but you need to check test locations and times depending on where you are in the UK. See Appendix O of the Immigration Rules:

I looked at the test.it isnt that easy for me.it should be,i guess my heart isnt in it.i looked at english language requirements once again.this time i have read it carefully. It says:you will be awarded 10 points if your are applying under tier 2 general and you meet the following requirements:
You have ever been granted leave as a:
-qualifying workpermit holder and
You have not been granted leave in any other categores other that Tier 2 general since Nov 2008.

Well, I was granted leave to remain as a qualifying workpermit holder in oct 2007.Then I switched to Tier 2 in Ausgust 2009.The : since 28 Nov 2008 bit is what I dont get.Would you mind to explain?

Do I meet the requirement detailed above? This is what I ticked on my application form as well.If so,then i dont have to worry about the test then do I?

If I do have to do the test, then I will just make a postal application for ILR.the 18 days that I am short will be covered under sec 3(c), correct me if I am mistaken please.
thank

You are right, you don't have to take the English test if you were a Qualifying Work Permit holder and then switched to T2G. Qualifying Work Permit Holder means a Work Permit Holder who was issued a work permit in the business and commercial or sports and entertainment work permit categories.

28 November 2008 was the date when the Points Based System started and your T2G leave was granted in August 2009, i.e. after this date.

For the T2G extension application you don't need the KOL test.

Suggest you check that the CoS confirms that your job is at or above NQF level 3 and that your salary is at or above the appropriate rate for the job (para 194 and onwards in the T2 policy guidance):
http://www.ukba.homeoffice.gov.uk/sitec ... e2012-cop/

Check the completed application form very carefully before you submit it and if you pay the fee by card make sure that there are sufficient funds in the account. Payment is usually taken very soon after they receive the application.

Remember, only submit ORIGINAL documents, not copies.

If the sponsor hasn't certified maintenance (which you can check from the CoS) you will need to submit documents as evidence of personal savings. See para 153 onwards in the T2 policy guidance.
