Tier 2 General to Dependant of Tier 2 General

Post by jasonlai » Tue Aug 07, 2012 11:12 am

My girlfriend and I are getting married and both of us is holding a tier 2 general point based system visa. She will be applying for dependent visa under my tier 2. My question is that whether she can quit her job and forfeit her tier 2 visa while waiting for her dependent visa to be approved.

She does not have to, but that depends on whether her current employer will hold her job while she remains outside the UK waiting for her visa to be granted.

Can she not apply for tier 2 dependant from within the UK? I am asking because she is now working in London while I am working in York. We are considering that she quit her job and apply as a dependant under my Tier 2 so she can come and live with me after our marriage.

No, and you should search the forum as this question is asked more than any other.

I read from the immigration rules that PBS dependant can apply within the UK. I tried searching for it in the forum but a lot of the result does not apply to my case.
A family member of a Tier 2 and Tier 5 Points Based System migrant applying in the United
Kingdom can make their PBS (Dependants) application online or using the equivalent paper
application form. Family members of a Tier 1 and Tier 4 Points Based System migrant applying in
the United Kingdom must make their PBS (Dependants) using the paper application form.
I read the above from PBS dependency policy. Does that not apply to us?

No. Again, I ask that you search the forum to understand better a situation that is asked and answered more than any other question arising.

I wish to ask about the cooling off period, as I struggle to find it in the forum. Please can anyone let me know if for my condition, my wife will be going back to the country and quitting her job, voiding her tier 2 general visa and applying for tier 2 dependant visa.

Does the cooling off period applies to her case or can she apply for the dependant visa immediately? How long can she stay in the UK after she quit her job?

Thank you.

The cooling off period is with exclusive regard to Tier 2 applications. This is not the case here.
