hi, i am applying for my ILR next month. MY wife is on a ICT - Tier 2 dependfent visa which is valid until june 2014. mty query is should i apply for a ILR depenent for my wife or does she can remian in uk on the same tier 2 ict - dependent . please can you advise.

Why can't she apply for ILR with you? When did she arrive in the UK and when does her visa expire?

hi, thanks for your reply, actually she can but i thought that anyways i need to apply for her dependent pr next year, as then only she will complete 1 year. so until then can she stay in uk in the same dependent work permit even if i move to ilr

When did she enter UK?
When does she complete 2 years?

So long as she does not travel out of the country. She will be elegible for ILR once she completes 2 yrs.

ICT dependent validity?

dear all,

Today I got my ILR, thanks to this discussion board which helped me in clarifying many doubts. I was in work permit and then in T2 ICT for 5 years with 5 months break in between. But it was very smooth PEO experience.

i have few questions, can some one clarify please:

1/ I got ILR only for me. My family (wife and 2 kids) are in India since Nov 2012. They were here in UK for more than 2 years during my 5years stay. They now have T2 ICT dependent visa till Aug 2014. Because I am now moved away from T2 ICT to ILR, will they loose their ICT dependent status? Can they travel to UK now using their ICT dependent visa? Can I wait till Aug 2014 and then apply for ILR dependent for them?

2/ If I apply NOW ILR dependent for them from India, which form should I use?

3/ Are they eligible for ILR direcly NOW from India as they have lived here already for 2 years?

They can continue as PBS deps as you were settled (granted ILR) as a PBS dep. Your wife's absences should be limited and for good reason regarding her settlement.

thanks d4109125. what are my options now. i dont have good reasons for their break. so can i bring them to uk in ict dependent visa itself? do i need to extend their ict dependent visa when it expires in aug 2014?
