ILR for Myself and dependant

Post by MJReddy » Thu Aug 09, 2012 6:37 pm

Hi Guys,

Just thought to share some important stuff. may be its useful...

i was on work permit for 5years. Straight forward application.

The case worker (Croydon) just look at the documents mentioned below.

1) 6months payslips and bank statements
2) Employer letter
3) Checked my absences
4) 5yr P60's

Case worker was not interested in any other documents. Please take above documents.

Due to some personal reason i didnt apply my wife ILR with me same day.

my wife got appointment in solihull. i was allowed to meet the caseworker as well. I took SET (M) application for my wife and the case worker was very good and told i should have applied SET (O) for her. we were a bit lucky, The case worker brought the form for me and i filled it there. you have to fill other reasons section in SET O form if dependant is applying seperately.
I was bit worried due to the cohabitation documents as they were not clear.

Cohabitation documents i had were

2yrs bank statements for both
Rental agreeements for past 2yrs
other than that i had bits like electricity bills not continuosly for 2yrs in anyones name.

if dependant is working its very useful. Hope this info is helpful.

Thanks,
MJ

ILR for Work Permit Dependent

Post by thulasi2u » Fri Aug 10, 2012 10:36 am

Dear Mr. MJ Reddy,

I am in similar boat. Brief outline of my scenario. I am currently on 5 year Work permit visa (from 05/10/2007) that expires on 05/10/2012. Therefore, I can apply for Settlement visa 4 weeks prior to 05/10/2012 using SET (O) application. However, my wife got “Visa Work Permit Dependent” on 01/05/2012, she entered UK on 17/06/2012, and her visa expires on 05/10/2012 (same as mine).

My simple query is can I include my wife as dependent in SET (O) application , even though she is in UK only for about 2 months as per the Immigration Rules, Paragraph 196D. So we both get ILR simultaneously.

Thanks.
Thulasi.

Work permit holders' dependents don't seem have to cohabit for 2 years.
