Dependant visa for spouse of Tier 1

Dependant visa for spouse of Tier 1

Hello All,

I need to file in my dependant visa for my wife who is currently in India. Could someone please answer my queries.

1] List of all documents that is required.
2] Who should be showing the maintenence funds, is it me or my wife bank account. Does my bank account statement suffice?
3] In terms of mycurrent residential address, what type of bills would suffice. I am currently staying with one of my friend and he would leave in a mont, but his name appears in the council/electric/rental agreement. Should I amend all of them and get new proof ?
4] English language requirement. Is there a necessity to pass the IELTS or a certificate from the university stating the medium of instruction for the graduation was english would suffice?

Hi Lucapooka,

I am applying for my Tier 1 General extension in October 2012 PEO, & then wil be applying for my wife extension in November 2012 ( as our visa expiring on Dec 2012)

Regarding Fund maintenance

I will be showing my salary account for my application,

Q1. Is it fine/valid for me to show the same account for my wife's application
I am maintaining 900 +600 GBP for 90 days

Q2. Do we need to show any resident proof, provided we are in the UK for last 18 months ??

Just want to doubly-confirm/clarify on the same thread

Please help

3 is not applicable? I thought that we need to show the proof of my residence ? Is it not the case. Could you please confirm?

It's not the case. Neither the rules or the application from ask for this requirement.

Someone said the he was asked for extra proof that he can bear the expenses for dependant and he provided salary slips. I dont know whether VFS(the agent for UKBA in India) worker asked him or caseworker asked him this. If it is VFS worker I would not worry much as they are not always sure what is needed and what is not. Anyway I could not get much information from the poster.

I think they cannot reject application because the paylips/rental agreement is not provided with dependant application. However, I suppose they can come back and ask for extra documents.

I dont know what could be a reason to ask for rental agreement/address proof. In the guidance it is given that care arrangements of children have to be in place as per standards. This could be a reason for asking rental agreeement when you are applying for a dependant child visa.

In my case, I would put salary slips for dependant application, because I have it with me. Would not worry about anything else. If they need extra documents they will ask.

That would be necessary in the case of a child PBS dependant, but that is specifically mentioned in the section of immigration rules for children of PBS migrants. It's absent in the case of an adult PBS dependant application.

Thanks Lucapooka! I think you are referring to 319H (I) which is given below.

All arrangements for the child's care and accommodation in the UK must comply with relevant UK legislation and regulations.

Do you think they can reject applications based on this, being a vague statement.

Only in connection with a child applicant; rules that don't relate to children can't be cited if the applicant is not a child.

1] How many months of pay slip should I provide? (If it is still an add-on document)?
2] My wife is coming from outside UK, VAF 10 is the right application for this?

VAF 10 is correct. Given that you know it's not necessary to provide payslips, you can submit as many or little as you wish. You can include a Domino's pizza menu as well, for that matter.
