Indian passport or British Passport

Indian passport or British Passport

Myself an my wife got ILR in May 2012. My son was born after ILR on July 2012.

I have confusion that whether to take Indian passport or British passport.

1) If I go for Indian passport, Is my child have to get ILR or British passport?

2) If He got Indian Passport as a first passport, in future is there any benefit after he got British passport and returned to India?

3) If I go for British passport, He will get OCI next year only. In the mean time what is the procedure for going to India. PIO card or VISA? which is better?

1. I did not understand this question. If you go Indian passport, you cannot have British passport along with it. So you need to ILR/FLR..I dont know much details about this process.

2. I don't think there is any benefit of getting Indian passport first and switching to British. He will get OCI in any case.

3. Depends on how frequently he travels. He can get a PIO and switch to OCI once a parent gets British passport.

I want to go with Indian passport. Because as a Indian, he is having birth rights in India.
If I cancel the Indian passport and acquire different nationality and return to India after some years and he will get Indian passport in 5 years with birth rights. But if I went directly to british passport, my son never get birth rights in India.

My question is, I want to go for Indian pasport, after this I can directly go to British passport or I have to take ILR.

Your second post is even more confusing, so I will reply to the first one-

You continue to be Indian citizen as you have ILR, your child can remain on ILR or apply for UK citizenship( assuming he is UK born), he can then take OCI

2) If He got Indian Passport as a first passport, in future is there any benefit after he got British passport and returned to India?

1.You apply for Indian PP for your child and he will continue to have ILR- he can return to India or stay in UK.No problem in India, here in UK who knows when the law will change for those having ILR. Already a new citizenship test has been proposed.
2.You apply for British citizenship for your child and he gets it- he can then take OCI. He can stay in UK or return to India in the future. In India he will have no problems, he will have all the rights, he cant vote or become an MP or join the armed forces. If he wants these options all he has to do is renounce UK citizenship and reclaim Inidan citizenship, he has to be living in india for more than 5 yrs for that, thats all.

3) If I go for British passport, He will get OCI next year only. In the mean time what is the procedure for going to India. PIO card or VISA? which is better?

He can apply for PIO straightaway if he takes up UK citizenship and youre still an Indian citizen. If you are going for Bristish citizenship, get him one as well. Or else he can remain on Indian PP as long as you want him to.

Wrong. All he has to do is take OCI after taking UK passport. He will always be Indian by descent and claim for Indian citizenship later. If you have doubts on this best recourse will be to first take an Indian PP for him and then take UK citizenship.

You will have to take ILR for him first if you get him an Indian PP first or else he will be without a visa. Hope that makes sense.
