My husband has not informed the uk border agency

Post by winnie236 » Wed Aug 22, 2012 1:11 pm

Hi, my husband who is a non eu national has not informed the uk border agency of our split up which occurred in March this year.
He is on 5 years residency provided he remained married.
He now wants to travel to Europe using the marriage details via an agency.
I informed them in writing of the split up but how can he get a visa.

Pls advise

You have already informed them of the split.......whether he gets the European visa or not shouldn't be your concern as you are no longer together.

Will he be allowed back in?who knows? My advice is just forget him and continue with your life.

I find you a bit rude.

Why should he be allowed to use a marriage certificate when we are not together.

I would gladly move on with my life if he would give me the divorce instead of saying he will sign nothing.

I don't ever want " it " in my life

I am sorry you find my post rude it wasn't my intention. Please excuse me as English is not my first language.

You have already reported him to the authorities there is nothing more you can do other than hope UKBA act asap.

As for him refusing to sign the papers just seek advice from a family lawyer.

winnie236, you need to appreciate that you do not have anything like a veto over whether your husband is allowed to remain in the UK, or not.
He is on 5 years residency provided he remained married.
So your UK immigration status is .... what? Just trying to work out exactly what "5 years residency" actually means. Are you an EEA national, and your husband is your family member?

Also, how long has your husband been in the UK?
John
