Stay extended due to appeal case

Post by legalhelp » Fri Aug 24, 2012 1:17 pm

Hi, when I made my initial application for tier 1 general visa, I had converted from student to tier 1, and my application was rejected, I then appealed against the decision and I was granted tier 1 visa.

2 question from this needs answers for my extension form.

1. On the extension form where it asks if i was ever refused visa.. what should I answer to this.

2. Also since the initial rejection and appeal were done after my student visa had expired, what do i answer for did i ever overstayed my visa. Though the application was done when my student visa was still valid.

Please advice.

No you weren't refused a visa, it was a refusal which was overturned . The second question is a no as you have never overstayed. You had right by virtue of Section 3D of the immigration act 1971

But don't you think the answer should be yes and then to be explained, because it was rejected
