so which one do i apply to

Post by egoneo » Sat Aug 25, 2012 12:17 am

so just a brief background. Born in u.k in 1988, left for Nigeria and came back in 1998(legally) when i was 9 going on 10. Ive been here ever since (14 years), but in 2003 when i was 14 years and a minor my boarding school sent my application in 13 days late.

and in 2007 when going to uni i submitted my application on time, but it was returned for me to tick a box on the form and get some letter from uni i could only get when i started. so that yer the visa expired 30th sept 2007, application was returned around 10th october. resubmitted it with documents around 5th november, leave granted on 30th november. but apparently even though i submitted the original on time, they returned the application and so therefore i didnt have valid stay for 2 months.

needless to say i didnt know about any of this untill i aplied for my 10 years in 2008. my twin sister got it but i didnt and we went there at the same time, same case worker, she gave my sister ilr but gave me refusal

anyway onto my question. Since the 14 year rule is abolished which i would have been eligible for in sept do i either

1. apply for 10 years on compassionate basis, that both my sisters and older have british passports and ive been here over half my life and developed friends

2. apply for private life ilr. im 23 and have lived her over half my life, but i heard something about having to stay another 10 years to get ilr and you only get limited leave?

3 apply under another category?

my visa expires this nov and is a tier 4 students. Thanks for your help and reading this long post
