Tier 1(Extension) To ILR : 4 Months Unemployment + Absences

Post by sali11 » Sun Sep 02, 2012 4:50 pm

Hi

I have been in UK since Mar-2007 (2 years on WP & then on Tier 1). My total days out of UK are under 180 days & all single absences have been under 90 days.

In 2010, I was unemployed for 4 consecutive months Jun-Sep 2010 (left & rejoined the same company).

During those 4 months:
1) I went out of UK for 45 days (Jun-Jul 2010)
2) then returned to UK for 5 days (Jul 2010)
3) again went out of UK for 70 days (Jul-Oct 2010)
4) and now in UK since then (Oct 2010 - Sep 2012)
5) During these 4 months I did not pay any tax (as was not employed) & did not pay any rent (as was out of the country most of the time).

My questions is that, is it going to be a problem for my ILR application with regards to Economic activity?

Many thanks for your time & help.

Hi,

From what you've said it doesn't look like you'll have any problems. Two things you need to be aware of: 1) so long as you haven't been out of the country for more than 90 days at any one time. From what you've said on all your time out of the UK, none have been over 90 days o you should be alright.
2) So long as you meet the required 75 or 80 points as set out in Appendix A of the immigration rules the you should be fine.
Hope this helps? By the way, when are you eligible?

A long days of unemployment is terribly bad. Expect the worst days ever when you have a jobless days in life. UK and US are just among the few countries that facing a great dilemma on employment rate. Lots of citizens are currently unemployed lately. The joblessness rate has fallen as more frustrated job hunters gave up the search. That is the only begrudgingly bright note in August's gloomy jobs report. You can get a short term loan to help pay your bills until you get a job.
