Spouse Working Abroad

Post by BillMaher » Sun Sep 09, 2012 9:19 am

Hi there,

My wife is settled in the UK. We are married but at the moment I am working abroad and visit her from time to time. I want to apply for a spouse visa but her income does not meet the minimum level of 18,000

Can I use proof of my income from my work overseas to demonstrate that I am financially stable? If that is an option can you tell me how it work? Will I just add up my annual income to hers?

Thanks,

Bill

No, but you can show savings to meet the shortfall. You have to subtract your wife's salary from 18,600 and multiply that sum by 2.5, then add a further 16,000. You need to have held this amount for the six months prior to applying.

We will not take into account the previous, current or prospective employment and earnings, or any job offer, of the migrant applicant at the entry clearance stage.

Just to re-cap:

Based on her total income of £X,000, she will need £Y,000 in savings to meet the threshold because ([£18,600 - £X,000] x 2.5) + £16,000 = £Y,000

I have overstayed my visit visa which was valid for 6 months by 1 year. During this year I got married and my wife is settled in the UK , she has got an Indefinite Leave to Remain (ILR)

Is there any hope for me to apply for spouse visa from inside the UK or will it be rejected because I have overstayed?

If I travel back home will this improve my chances?

Thank you,

Bill

From "working abroad" to "overstayed in UK by 1 year" in a week!

Apply for entry clearance from outside the UK (i.e.- country of citizenship / legal residence).

Thanks for the response. Actually this question was posted on behalf of a friend, he was too lazy to setup a new account.

Stating this simple fact in the first instance would have helped.

Hello friends,

My wife who will sponsor me does not have a bank account as she works a part time job and she gets paid in cash. Can she sponsor me?

I have the funds for income shortfall in my account
