ILR Dependent Qualification

Hi,

I'm currently on Tier 1 living in UK and completed my 5 years of stay in UK on 27-Jul-2012 and eligible for ILR (offcourse along with other qualification critieria). I'm pretty much clear on my eligibility and have few questions regarding the eligibility of my dependents. Details are as follows.

1) My wife travelled to UK for the first time as a Tier 1 dependent on 18-Aug-2009. She left to India for delivery on 17-Jan-2010. The number of days she stayed in UK in that trip totals to 152 days. She lived in India from 18-Jan-2010 till 02-May-2011. I went to India and brought my wife and son to UK on 03-May-2011. Both my wife and son are living with me in UK since then (i.e., 03-May-2011). Please, can you confirm whether she would need to complete 2 years of stay in UK (ie., 365x2=730 days) to be eligible for ILR?

2) My son born in India who came to UK with us on 03-May-2012 carries a Tier 1 dependent visa. Does the rule to stay in UK for 2 years applies to him or is it just applies for the partner ?

Appreciate you guidance on my above queries.
