Naturalisation application rejected

Post by runnerown » Sun Sep 16, 2012 11:02 pm

Hello Every one
I have applied for my naturalization application and it was rejected because, i have had a court fine for speeding.
The initial fine for speeding was a normal Fixed penalty fine from police, which was not paid due to mitigating circumstances and this was taken to court and i have accepted the fine and was settled by post.

Now when the court issued me this fine, they said its not a criminal offence and nor my Enhanced CRB check shows any criminal convictions.

So i would like to know where and how does UKBA check for criminal convictions, and how can i access that file.

My appeal for my Naturalization was rejected as well, so if i want to further discuss my application - what should i do??

Please advise

Can you please the full text of refusal or the traffice offence code ? I am sure many people who have been in the same situation will help you.

I have applied in October 2011 and received rejection in Dec 2011.
Before applying for my application I did checked my CRB and I doesn't show I have any convictions.
So can any one suggest where does UKBA check applicants criminal record???
I have recently requested for subject access from UK police computer and should receive it next month.

Any suggestions pls if I want to reapply .

Pls advise

Not in every case. But in this case, I would agree.

OP, did you appeal or ask for reconsideration? AFAIK, there is no legal provision to appeal a naturalisation refusal.

UKBA can access each and every database available for the purpose to access criminal records of applicants. No one but an insider will be able to tell which one(s) they use! That said, the CRB report should have reflected the conviction.

Where did you get the "enhanced CRB" check done from? And through whom?
Did you declare the offence and the associated details in the application?
Also, share the date of conviction and date of CRB report.
Life isn't fair, but you can be!
