Applying for marriage visitor visa - suggestions please!!

Post by lope85 » Tue Sep 18, 2012 12:12 pm

I am currently living in the UK and I am pregnant. My partner and I have decided to marry in the UK and then move to his home country. The baby will arrive in November and we'll get married in a registry office once it is born.

I am worried about the length of time it may take for this visa to be approved and about reasons it may get refused

It would be great if he can be here when baby is due and for us to get married - (it will make things a lot easier when applying for visa for his country.) Worried about MVV getting refused though and us not being able to get married AND him missing baby. His priority is being here when baby is due.

Does anyone have any experience of applying for this visa ? is there more chance of a successful tourist visa application? ( - we'll then just get married in his country ).

He has studied and worked in the UK previously and left before his last visa expired. He is currently awaiting a new passport. We don't have much savings but my mothers kindly offered to be a third party sponsor for the MVV. He will just stay for a month.

If anyone can offer some advice it would be great!
thanks

Motivation to return is paramount with this type of application: if his ties to his country are not good, the visa may be refused. The fact that you say you and your child will be returning with him make it even more relevant that he has an established life to support you. If he has nothing to show with regard to this, then your stated intentions will lack a certain credibility. A wife and baby in the UK is a huge anchor that the UK may not be willing see him drop on his arrival!
I note that your previous questions were in regard to a settlement application so you need to get your facts sorted before you proceed. Also, be aware that, unlike with settlement applications, visit visa are subject to general grounds for refusal for breach of the immigration rules. If your partner has any negative issues in his UK immigration history, these will also be applied to his application.

Hi Lucapooka,
thanks for reading my post. We are not wanting to settle in UK now as we can't afford to because of the change in family immigration rules made in July this year. I don't think he will mention in application for MVV that I am pregnant - as you said this will appear as a huge anchor for him and possible grounds for refusal (he will apply before baby is born so he won't be lying on application about any dependents). I suppose he could include photocopies of my past visas to India when I have stayed with him, this may help prove i have stayed there with him in the past. he does not have any negative issues in his UK immigration history.
thanks for your help.

Indeed, he is only obliged to answer the questions presented on the form rather than offer additional information that is not requested, and may have a negative impact. There is no question that asks if the proposed spouse is pregnant so he has no need to offer this information.

thought so :) I have come across some email correspondence, from earlier this year, between myself and some visa agencys regarding applying for spouse visa for India. I think if my partner includes this with copies of my previous visas it should be suitable evidence that we are serious about leaving uk together.
