ILR query

Gents,

I have a query i was hoping you might be able to help me with.

My existing Tier 1 General visa expires next january and i am eligible to apply for my ILR this december. i recently went on holiday with my family and when we got back to the UK my son who was born in the UK and has a canadian passport was given a three month visa at the point of entry. The three month visa that he was issued expires a week before i am eligible to apply. This is an issue because i intended to include him in my application as a dependant. someone told me it is fine because he has 28 days after it expires for me to apply but i am not too sure about that.

Please can someone advise?

How come you have gone from being a Tier 2 migrant to being a Tier 1 (General) migrant within 2 days?
Don't assume multiple immigration histories. If asking a query on behalf of someone, clearly state so. Ignore if typo.
