I'm a non-eu who got married to my Brit/Irish man - in UK - & applied for the EEA FM after solicitor said it is ok! (we applied after consulting him NOT Through him), then I found your page shocking me that our application will be refused then me & my husband discussed the situation & find the best solution to renounce his British citizenship & he did 3 months ago.
The stressful situation here is:-
A- We're expecting the refusal letter between Jul/ Aug. & the RN Certificate between Aug./ Sept.
B- Due to the referendum & the new agreement it may affect the whole case as I was overstaying with a few months before the marriage (Due to a mistake of another solicitor)!
--- Actually, I suggest to withdraw the application & reapply again before the 20th Jun.
1- Any ideas whether I should leave time between withdrawing the eea fm application and reapply or it can be next day? (If I don't need the documents)
2- Do you think it affects us that we are doing the whole process from inside UK?
Any suggestions in general, as I feel we are walking in the dark & I can't trust solicitors anymore

Aaahh OK I get you now! So you got married and then applied for the Residence Card basically (this is what you apply for INSIDE the UK - the EEA Family Permit is an EEA1, which you would have done from OUTSIDE). Yea if your husband is still British it will probably get rejected - even if you do slip through the net, it could come back and be in issue farther down the line e.g. applying for permanent residence etcAmy16 wrote:Hi sp84,

Actually we live in UK, so we applied for EEA (FM): Family member or previously called EEA2 (from inside UK) - which as u know takes average 6 months - Not the FP Route.
It also scares me that everyone here applying from outside! do I miss something?!
Concerning the RN, Yes my husband sent his RN 3 months ago and I've sleepless nights since then!
That's why I think to withdraw the application & reapply before 20th (If I didn't receive the RN certificate v. soon), as the new rules are not our best choice..

The 91 page doc for the 5 year card isn't really 91 pages... we got ours down to 25 i think it was! So if you prefer and don't want to kill a few trees and use all your ink look at what applies first. hehe..
My husband went to Birmingham to do biometrics (again! after having them done in SA) and not to long after that he got the letter saying he will get a reply in 6 months. Since then the who Brexit vote took place etc etc. But thankfully not much will change over night with that so no worries!
Hope everyone else is okay and managing with docs, they do seem scary and daunting but just give as much info as you can especially to do with your relationship and they seem happy with that in the first stages
