PBS dependent or FLR(M) !

Post by rk_confused » Wed Sep 26, 2012 5:32 am

I have spent over 2 days going through forums and try understanding whats applicable to me but in the end have left myself more confused; and thus finally posting my query. I know this topic has been discussed in much detail but if you can just bear with me.

Current : Tier 1 (General)
Valid till : Dec 12
Applying for SET(O) : Oct 12
Spouse : April 11 - UK arrival, PBS Tier 1 dependent, Valid Dec12, Not Dentist/Doctor

My wife cant apply for settlement as she has not spent 2 years, thus according to different forums here I have 2 options:

1) Extend pbs dependent leave for my wife according to 319C & D.
2) FLR(M)

I know both options are open but I am not sure which is correct. Can someone please advice as the amount of documents for option2 are far more than option1 which is comparatively straight forward? Also what about fundamental requirements of english language for option 2 only and not for option1.

I am in the same situation as your wife and am still thinking what to do, but have booked an appointment for FLR (M) anyway.

does anyone know how long is the FLR (M) granted for?

There is no right or wrong option its your choice. Extending leave as a PBS dependent is simpler by far.

I think FLR(M) is valid for 30 months. Not sure about Tier 1 dependent extension.

Also not sure which route is the best for settlement (SET M)?

Thanks

Are PBS dependent extensions good enough to apply for Settlement (SET O) after 5 years or she has to move to FLR(M) before applying for settlement?

Thanks,
Suresh

Good enough if the principal migrant will be applying for settlement as a PBS migrant (economic route, 5 years).

Hi Fellows,

Need your help. My case is also similar.

5 year completing -- End of Nov 12
Dependent Visa Expiring -- End of Nov 12
First entry of Dependent -- Jul 11

I guess its easier to apply for "PBS Dependent". is it correct? Which form do I need to use? Tier(1) General Dependent.

In case of FLR(M) dependant need to meet the English Language requirement + several other documents.

Any comments or guidance please?

Cheers
