Habitual Resident Test

Can somebody please explain about this Habitual Resident Test. I am also a returning British Citizen. I need to know also if I and my spouse (Non Eu) can apply for a Job Seeker Allowance? I leaved in France for 2years excercised my treaty right as a worker. I and my non eu spouse are now back in the UK.
I will greatful for any information or advice that will be given.
