I left the British Army 6 years ago and went to travel in Australia where I met my wife. We married in Australia after living there together for a year. I returned to England 4 years ago on my own because I only had a visitors visa to Australia. My wife then flew over to be with me a few months after. But Immigration stopped her and refused her entry and was going to put her on a flight back home. They agreed to let her stay with my Mother for the night before returning to the Airport the next day, the person in charge at the Airport Immigration was ex-army and kinda understood our plight I think.
But my wife never returned to my mothers to be sent back to Australia, we both went to live in London. We had to live on the streets for a couple of years because of this, I had no work and only a single persons benefit to survive on. Also housing benefit rules meant it was impossible to find anywhere for us to both live. I worked the Big Issue for a couple of years and we got a deposit for a tiny room where we lived for the past year. But now they want to increase the rent because of the Olympics being in this borough so I am back to square one again.
I am wondering if it might now be possible for us to try and get my wife Leave to Stay in the UK with me. I am not sure who to goto for Legal Advice either because we are both almost destitute because of this. My health has suffered severely because of wanting to live together with my wife. I dont have any other family or friends in the UK now, my mother having passed, so if she was sent back home still then I wouldnt want to carry on living here alone without her anyway.
Is there a way to use the Human Rights or anything with our case ? Thankyou very much in advance to anyone who might be able to help or offer any advice on our plight.
