uk marriage visa - living together requirements?

uk marriage visa - living together requirements?

I am a British Citizen settled in the UK and my GF is Amercian. We plan to marry in the US in 2014 with further plans for her to then move to the UK thereafter via a UK Spouse Visa. Having reviewed the UK Border Control Visa requirements we are confident in meeting all of the necessary criteria with the exception of 'genuine & subsisting’ requirements where it states that as a couple we must have lived together for 2 years or more, with evidence of a joint tenacy agreement, joint account or responsible for utility bills etc.

We were wondering if our circumstances are taken into account as our relationship is very real and we can tick all the other boxes and provide evidence of our relationship, however with me residing in the UK and my girlfriend in the US whilst she finishes her studies there etc – we are not in a position to live together until we marry.

Any advice or assistance that you can provide on how this may be viewed by UK Border Control or possibly overcome would be much appreciated.

5Where does it say that a married couple must have lived together for at least two years? This is the requirement for unmarried couples.

On the can you apply section, when you click the 'genuine & subsisting' link, it mentions cyrrently living together & shared responsibilities such as utility bills, tenacy agreements etc.

Apologies i may have misread regarding 2 x years specifically.
