Refused PSW Application .... 10 years ILR eligibility

What have you said in your covering letter as to why you will be unable to attend?

Unfortunately from 12 of November I am suffering from lower back pain. Immediately I did seek my GP and taking treatment. Yesterday I have seen my GP again because I feel some side effects from this medicine. Also on Monday 26 of November I need to take Physiotherapy in X Hospital. In this situation I am unable to travel form X to Hatton Cross. I do not want my attendance in uncertainty as it is very important for my future.


Please help Is it going to be ok ? Thanks

Sorry the appointment for Physiotherapy same date as hearing date 29th. So I can not attend in tribunal.

Wiithout a letter from a medical professional explaining why you are medically unable to travel i doubt your hearing will be adjourned. There is no indication of when you will be fit to attend-if it is merely the clash of dates with the physio appt then at the most the might just adjourn to the next available date, which may only be a few days later. They cannot adjourn for more than 28 days (unless there are no dates available before then) however they are more likely to refuse the request outright.

Yes they changed the appeal hearing date to 10th of December. And 5th of January its going to be my 10 years. What is the option now for applying ILR? Its still more then three weeks to complete 10 years.

I think you should be alright.

2 reasons -

1) The result of the appeal wont be declared immediately. it will take anytime from 1 week to 2 or 3 weeks. its x-mas and new year time as well. Also you can appeal in the high court again

2) even if your appeal is rejected immediately, you still have 28 days legally to switch to another category

guys i need yr help i went for my hearing today because i hve applied PSW on the basis of fundmaental level of acca .. my psw was refused anywz judge adjourn my appeal and he asks for more evidence i got question when i went in hearing room at ist Judge mention that your visa refused on the basis of 245fd what is this?? can u please ellaborate thanks but on my refusal letter nothing mention 245fd

but i did nt applied ILR i hve applied PSW that time but come judge hve mentioned that rule on me.. i m getting confused here..

The requirements are for Tier 1 (PSW) not ILR, I am sure you did not read previous posts and archived section 245FD. ACCA not a degree that's why your application was refused.

yah i hve read the post but the problem is 245fd requirments wasnt there when i applied my psw and that time it was policy guaidence.. but i was surprised why judge was refreimg the 245fd

Of course 245FD was in the rules at the time you applied. The requirements for psw were not just contained in policy guidance. What makes you think otherwise?
