I cant make my target with salary + dividends only. that is why i claimed for salary+ net profit of the company as I did the same for the initial application. first time got it same day. this time they have checked and verify all my invoices. but still send me a refusal. I am desperate to go home for urgent family reasons. that is why i went for a peo on 10 sept 2012 they send me back saying they will verify my invoices and take a decision in 2 weeks but send me a refusal after 12 weeks. got to go home urgently but cant do anything and they retained my passports too.

don't know what went wrong. can only cry cry. worked in nhs and private day and night to achieve this but ............

Just to let you all know, that my application for Tier1 (G) extension is approved. I got an email from UKBA, saying that, since I am the director of limited company, I am considered as an employee as far as HMRC is concernt, and I do not need to provide any additional documents. They also apologized for the mistake in assessing my application by PEO Croydon.

Thanks all for you help specially Sushdmehta.

Cheers,

Hello asethi,

First of all, congratulations that you got your extension. I will also be applying for extension at the end of the year and I realized that I am in the same situation with you.

Unfortunately HMRC and UKBA have different definitions of "Self-Employment" an if the caseworker is not very experienced, you can easily be refused or deferred.

I have a small request from you. Is it possible if you can share the scanned copy of the UKBA letter stating that "since I am the director of limited company, I am considered as an employee as far as HMRC is concernt, and I do not need to provide any additional documents"?

Of course you have to hide all personal details (name, application numbers...etc.etc) in the document and maybe you can leave only the sentence related to the issue on the scan together with the UKBA logo :).

If you can share this within the forum, this will really help many people and they will have a reference for the further applications.

Thank you,
klamox
