Appeal for General Visitor from Bangladesh

Post by hummy » Mon Oct 29, 2012 2:22 pm

We applied for a visa for a cousin of mine who is 30 years old, single for a visit visa to the uk.

The reasons for refusal, were that he submitted a business bank account statement rather than a personal bank account. However the business is his and he is the sole owner and he is the only person that runs the business. The benefactor of the business account is himself.

He takes money out of the business bank account as needed. He doesn't really use a personal bank account.

What sort of thing could be submitted in order to verify this and grant the visa on appeal. Any thoughts?

There is not appeal for visit applications. He should re-apply with evidence from the bank and perhaps his accountant.

Why do you say there is no appeal for visitors. Becuase on the decision notice it does say he has right of appeal.

That would be a limited right of appeal on the basis of facial discrimination. Did the ECO say he was refusing the visa because of your cousin's race?

Its very difficult to make out exactly what we can appeal on based on teh decision letter. It seems they ran out of ink on their printer when printing the decision notice.

I believe the section is refers to about the email is 84(1)(C).

The legislation website says the following about this;

(c)that the decision is unlawful under section 6 of the Human Rights Act 1998 (c. 42) (public authority not to act contrary to Human Rights Convention) as being incompatible with the appellant’s Convention rights;

You can't appeal the reason for the decision and need to apply again.
