Clarifications needed on ILR & Co-habitation

To all the senior advisors of the forum,

Following are my details pertaining to Tier 1(General):
EC clearance obtained :29- Jan-2008
Intial UK entry : 2-May-2008
Extension details : 29-Jan-2010 to 29-Jan-2013
Due for extension (or) ILR : 29-Jan-2013

1. About my case:
I got my Tier 1 (General) - first Entry Clearance on 29th Jan 2008, But I stepped into UK on 02/05/2008. that is exactly after 94 days. I'm aware of the 90 days rule introduced by UKBA. Should i go for my 2nd extension for the remaining 4 days or there are any other options to get my Permanent Residency.

In case if there is no option to get my ILR without my 2nd extension, If I opt for my extension for another 2 years, in that case I would be satisfying the 4 days shortage for the 90 days rule. After which would I be eligible for my permanent residency from 2 or 3 rd week of Feb 2013 onwards.


2. Regarding co-habitation:

My spouse went on maternity to India during April 2011 and back to UK on June 2012. Fortunately we're blessed with a baby boy in this tenure. We've all the docs pertaining to the maternity. Would this cause any problems to co-habitation. But before maternity my spouse was with me from June 2009 to April 2011. If there is a problem my co-habitation, I would like to know the work-around on this (options available to continue our leave to remain in UK).

Any suggestions/advise would be of great help to me. Thanks in advance.
