British wife, Russian husband and Canadian born child

Post by Carol-Montreal » Wed Nov 07, 2012 8:29 pm

Hello,

I am British born and living in Canada for 5 years. I have a 2-year old daughter born in Canada and a Russian husband, soon to receive Canadian citizenship. We hope to move to the UK next year.
My questions:
-should I get my daughter's British passport before we move back to the UK or can that be done from the UK?

-Any advice on the timing of applying for my husband's spousal settlement visa? Once they issue it, do you have to leave within a certain number of days? We're going to sell the house, so need to time everything around that.

Thank you

Yes, get the child's passport before you intend to settle in the UK.

The spouse visa application generally takes between a few weeks to 3 months (in cases that are not straightforward). It will be issued with a validity not in excess of 33 months and he can travel any time within that period.

I'm British, husband Canadian/Russian, both living in Canada. We hope to move to the UK next year. I've just been looking at the settlement visa form and at the end it asks me to select an appendix, but none of them seem to match our case:
Appendix 2 is for: The spouse or civil partner of someone settled in the UK --
but I am not yet settled in the UK.
Which one should I select?

Thank you!

Read it to mean - spouse of settled person (or British citizen).
Not explicitly stated but is so.

really! I'm surprised because in other descriptions they use the phrase 'person settled, or going to settle, in the UK' but in this case there is no 'going to settle'.
Thanks
