transfer from dependent on ancestry to T2?

Post by lemontarts » Thu Nov 08, 2012 11:39 pm

Hi,
I'm an Australian dependent on an ancestry visa and our marriage is looking shaky. Soon after I moved to the UK (Nov 2011) I got an amazing job at a university (academic position requiring a PhD) which would have qualified for T2 had I wished to apply for it then (Feb 2012, with all the necessary bits - advertisement length, ability to sponsor, evidence of funds, qualifications, etc.). Would it be possible for me to switch to a T2 if my marriage breaks down at my current job? Or would I have to go back to my original country & reapply? Would they have to re-advertise my job?

I realise this is an uncommon question, so I'm a bit desperate to find out what my options are - my job is my dream job, and I've been a great citizen! :)

edit: looking through the restricted certificate codes, it seems that my job would fit in one of the PhD-level SOC codes (researcher) - and thus may not have to do a RLMT? Would that make it exempt from the RLMT (and thus make it easier for my university to offer me a CoS, even if I have to go back to Australia)?

Thanks for the reply, but it doesn't answer my other question - I don't mind popping back to AU to apply for a new visa, but will my employer be able to give me a CoS for my current job or will they have to readvertise etc.? I don't want to lose my job!

Thanks very much!

RLMT (re-advertising) not required if the job SOC code is 1137, 2111, 2112, 2113, 2311, 2321, 2322, or 2329 but you will have to be paid the salary appropriate to the actual SOC code.

There is still some hassle involved for the university because they will have to apply for a restricted CoS (assuming they have a T2G sponsor licence)
