Attention: PSW- Tier2 6 months period requirement

Post by blobfish » Mon Nov 19, 2012 11:32 pm

Confirmed not needed.
from homeoffcie:
As per the current Guidance:

“Tier 1 Post Study migrants switching into Tier 2 General are not required to submit the evidence of their employment (pay slips and/or bank statements) as per the current rules. However, the system hasn’t yet been updated to reflect this in the online application form. So applicants can select “No” to these questions (related to supporting documents).

However, applicants have to submit bank statements in evidence of meeting the maintenance requirement, if it is not certified by A rated sponsor.”
I am filling the tier2 online application form and found the 6 months period is required for PSW-TIER2 now:
The Post study work provisions mean that if you are applying for Tier 2 from within the UK and you meet the requirements set out below, your sponsor will not have to show that it has done a resident labour market test in order for them to employ you in your prospective job.

You qualify for the Post Study Work provisions if you are applying for Tier 2 (General) from within the UK and are switching from:

▪ Tier 1 (Post Study Work)

▪ Fresh Talent Working in Scotland

▪ International Graduates Scheme (or its predecessor, the Science and Engineering Graduate Scheme).

The job that you are doing must be the same job that you are being sponsored to do at the time you make this application. You must also have been working for your sponsor for a continuous period of 6 months, immediately preceding the date you submit this application.

The online form hasn't been updated. The 6 month requirement was removed in April this year.

2 months ago I filled the form once online and it didn't show this message. But it shows now so they may updated the online form. Also, it shows on supporting documents as well.

The online form does not set out the rules.

Read paragraph 78C of appendix a of the rules and you will see there is no 6 month requirement when switching from post study work. The requirement was removed in April to coincide with the scrapping of psw and the new rules for tier 4 migrants switching to tier 2 and being exempt from the RLMT.
