Hello,

My husband and I got ILR in Nov 2012, i have a doubt if next year in nov 2013 my husband doesn't want to apply for BC, can I apply for BC?

As my husband will not take BC would i be eligible to take BC under 3 years rule.

Also to mention I am in UK since 2008 as dependent so in 2013 I will be physically in UK for 5 years.

Can someone please throw some light on this.

thanks Jombo, I have seen that already but my questions is would I fall in 3yrs rule or 5 yrs, I know 3 yrs i apply together with my partner.

But if i apply on my own.

3 years only apply to applications made by spouse of British citizens. It is not for joint applications.

For naturalisation, each applicant needs to meet the requirements (including the 3/5 years residence period). There is a reduced fee when applying together.

If one applicant meets the 5 years residence requirement but the spouse doesn’t, then once the applicant is granted BC (after the citizenship ceremony), the spouse becomes a spouse of BC and can apply for naturalisation under the 3 years residence requirements.

So anyways next year i will have 5 years in UK so can i apply on my own BC.

I arrived in UK in Nov-2008 so by Nov 2013 I will have 5yrs including ILR.

So can someone confirm if this is correct??
