Switching from tier 2 to spouse visa

Post by zahira » Sun Dec 09, 2012 4:12 pm

Dear all,

My husband is on tier2 visa since last June. I have been granted ILR (from tier1) recently and would like to know if it is better for him to switch to spouse visa. I believe that before he could get ILR after 2 years on spouse visa but heard that there was new rules that made that 5 years instead. Could you please help with any relevant information on this situation?

Many thanks

You can apply for settlement as a husband, wife or civil partner if you have completed a period of 5 years in the UK, with a visa or permission to remain here in this category;

........which would not include any time previously spent in another immigration category.
