Which Visa for my Kid ?

Hi All

My husband recently got his ILR approved and I am in Tier 1 Dependent Visa valid untill May 2013 and staying in India, planning to go to Uk before May with the existing Tier 1 Dependent Visa.

My question is under what category we should apply for our Kids visa born in India.
Should we apply as a PBS dependent(VAF10) or as Family settlement(VAF4A) ?
If it is VAF4A should we apply appendix 1 or appendix 2 ?

I am of the understanding that, because you are not inside the UK, you should both apply for settlement visas. If your location permits paper applications it would be the VAF4A. I hope I am wrong and perhaps some other member can enlighten me and refute the requirement for you to apply also. However, from your position of being outside the UK rather than inside the UK, I can't see how you can continue with your existing leave now that your partner has switched his status.

Thanks for the reply. My Husband has already confirmed from UKBA that I can travel to UK with TIER 1 Dependent before it expires.
