Working During Application for Visa?

Post by niomi » Tue Dec 18, 2012 7:54 pm

I'm applying for an entrepreneur visa and my Tier 4 student visa expires January 31.

To my understanding my visa is extended until I receive the results of my application. Does this mean I am still allowed to work full-time, anywhere, without sponsorship?

Also will I be able to still look for jobs and switch into Tier 2 with the perks of a Tier 4, even after my visa expires? I.e., without being subjected to the resident labour market test?

And then cancel my current entrepreneur application?

1. If you filed an 'in-time' application, and until a decision is made on that application, you continue to be bound by the conditions of your existing leave.

2. If your current leave has work restrictions, then you will continue to have those until a decision is made on your ongoing application.

Thanks for the reply. I called UKBA today and she said this was true but at the same time stated that as a student, my right to work expires 4 months from the completion of my studies (which is when my visa also expires). Is it really correct that my visa will NOT expire after 4 months while I wait for the application results, but my right to work will?

Read through http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

However, would you need to continue attend some form of educational institution during the 3C leave? Maybe experts can weigh in.

Thank you, I'll read this. Yes an opinion from an expert would be great!

I called the UKBA back later and they gave me a different answer. I was told that 4 months after my programme ends, I am allowed to work but ONLY part-time. I'm so confused with all this contradictory information...
