Spouse visa query

Hi,

I am changing employers for tier 2 on the 7 th of jan 2013.

My husband will be applying for a spouse visa from india after I get my new visa ie by the 14th that is when I get my BRP
My problem is the last payslip for December 2012 is dated December 14, so when my husband applies for visa it will be more than 28 days old. According to the guidance it should be no older than. 28 days.
What can I do?

You have two options.

1. Wait for your first payslip to arrive with your new employer and then make an application.

2. Along With your december payslip, provide your new contract and offer letter from your new employer with a covering letter explaining the situation.

Thanks for the reply, very grateful.

My query ahead may sound quite confusing, but i will try and ask

Incase I want to wait for my first payslip with the new employers, i will have the following situation.

I will have 12 mnths payslips from old employers till 14 december. They will not pay me from 15 dec to 7 jan(my last working day with them). I will join the new company on jan 14.

So i will have no salary to show UKBA from 15 dec-13 jan. Will that be a problem for the spouse visa

What visa are you currently on?

how come your husband apply for spouse visa when you don't have ILR ?

I think you should be fine. However have a thorough read at Partners and children of migrant workers

Use VAF10 Form and also read VAF10 Guidance for further assistance.
