Company may close their buisness but my visa's still pending

Post by annacotta » Fri Jan 04, 2013 10:54 am

Hi all,

I'm in a very frustrating situation. A few months ago, my company promised to sponsor me and they are ready to apply for my visa Tier 2. I have just enrolled my Biometric information yesterday and the agency said I was likely to get it as I got 70 points so things should be fine.

However, I've just been informed today that my company might have to close their business next week or next month if the investors were not pleased with their profits. This may not happen but in worst case scenario, I would be made redundant while my visa was still pending at UKBA and waiting for the result.

I am currently holding PSW visa which will expire on February, 12th 2013. Could anyone please suggest me what I am supposed to do?

1) Will my visa Tier 2 (if I get one) still valid if my company stops running their business?

2) Can I wait until the visa's result come out and look for a new job until February, 12th? If so, can I hold Tier 2 visa and apply UKBA later to change my sponsor?

3) If I cannot use Tier 2 visa to stay here, I have to go back to my PSW visa and looking for a job offering me a sponsorship and apply for Tier 2 again?

Sorry for my long message but I am very stressful and frustrated about this situation. Your advice would be much appreciated.

sorry to hear that.

q1) no it's not they will send you a mail saying it's canceled and you have 60 days to find a new job.

q2) up to you but wont go down well with UKBA

q3) yes start doing that now.

Hi Studio123,

Thank you very much for your prompt response. I am really appreciated it.
Just wondering if my company closes down, do I have to inform UKBA or it's my company's responsibility to do so?

Please kindly suggest.

I think ukba will know because of the sponsor system. It's a good idea for you to say it and withdraw your application and apply with your new sponsor.

Only have to do all of this if they actually stop trading. what ever the case start looking for new sponsor.
