Hey guys

Need some assistance.

I know of a woman who arrived in the uk on a spouse visa, she sjbmitted a ILR application to the home office, her husband subsequently had written to home office advising he has broken relationship. Husband applied for travel document for her and sent her back to pakistan with her three children.

Three of her children are british nationals, all three have british passports, mother is now in pakistan with all three children.

Mother has now applied for a visitor visa to come to the UK so that she can make an in country application on the basis of being a parent of a british child and furthermore the elder child has resided in the uk for over eight years as he was born her.

Thebquestion is, failingnthe visitor visa application is there any other avenue which she cant avail to come to the uk as she has a strong case on the basis of both domestic violence and britisb bornchildren

Can anyone advise of alternative route

She could apply for an EEA family permit under Regulation 12(1A).

If the domestic violence allegation is properly documented, this may help.

Hey

Thanks for the reply. Good option however there are 3 children with two who have british passports and the third childs passport is with the husband who they do not get on with.

In the circumstances what can be done for the thirld child?
