BC for my Kids

Post by cks333 » Thu Jan 10, 2013 11:47 am

I got my ILR in May 2012 after 5 years of HSMP/Tier-1 and is due for citizenship in May 2013. Due to family circumstances, my wife and my kids are living overseas currently. My wife's visa expired in Dec 2011 (was on her own Tier-1) and we did not renew it. Our son was born here in UK in Jan 2009 and our daughter was born overseas in May 2012. Now coming to my queries.

1. My son was dependent on me since his birth and hence got ILR for him in May 2012. Gurus here told me last year that i can apply for BC straight using MN1 but due to time constraints, i got ILR for him in May 2012. Did any rules change after that for MN1 ? Can i still apply for his BC eventhough I am the only one in ILR and my wife does not even have FLR at the moment ? or is it best to wait until my BC before applying using MN1 ?

2. My daughter was born overseas after my ILR approval in May 2012, what are the chances for her to get BC ?

Many thanks for your time and inputs.

Your son can register as British. Your daughter will have to apply for a settlement visa along with your wife.

Hi Lucapooka,

Many thanks for your reply.

You said - Your daughter will have to apply for a settlement visa along with your wife.

Is that the FLR route of 3 years and then apply for ILR / BC ? I remember HO changing some rules last year and hence a bit confused.

Thanks for your time.

Your daughter will be granted permanent residence ILE from the outset; your wife will get have to wait five years for her ILR.
