Validity of ILTR after being in Australia 8 years

Post by CPI » Sun Jan 13, 2013 2:31 pm

I am australian and I lived in uk for 6 years and got my indefinite leave to remain through ancestry. I married a uk citizen and came back to Australia for 8 years, every two years going back to the uk for a month. We are planning on going back to uk to live. Will my ltr still be valid?? Do I reapply or can I do something in relation to my husbands uk status? What about our four year old? Thanks!

You will only know if it's valid when you arrive at the border. It seems that you have been readmitted in the past but the reality is that you were supposed to be returning to settle rather than visit, and this seems to have been overlooked on several occasions. You have no close ties to the UK so applying as a returning resident would not work. It's best to wing it at the border if your last visit was less than two years ago.

Thanks-what about my daughter?

I had a close look at my passport and they wrote vipp the last time I went through and I recall the officer saying something about as long as I come through within two years, I should be ok. So, any idea what I have to apply for to get my daughter residency? Or am I better off applying for a passport using her dads British status?

Your chance of re-entry to the UK has been discussed. Your daughter should apply for a British passport.
