So when your visa is expiring? I would have gone for Level 8 but I was hoping to get positive outcome from the court and didn't plan beyond that. I'm really in trouble now. Thinking to pack the luggage and book tickets to go home.challenge wrote:@czybis
True no updates about khatel even on zane maliks fbook there are no updates.
I am in somewhat similar situation, have been looking for some other option one of them is level 8.

So, in this case do they still have time to appeal to SC?? If not surely very soon we all will receive letter from the court saying our case is over because they didn't apply for an appeal within the extended time frame. This is just my opinion. What you guys think.Letter dated 25th July
By way of an update, I understand that the appellants in SSHD V raju did not make an application for permission to appeal to the SC within the time frame for doing so. However, we have been informed that by the appellant's solicitors that the appellants are seeking funding and they expect that applications would be made early next week, with an application to extend time.
Accordingly, the defendent will update court as to whether an application has been made next week.

I note that the consent order dated 16th may 2013 stayed these proceedings pending the COA's judgment in Khatel and others.
The COA handed down its judgement on 25th june. The respondents sough permission to appeal from the COA to the SC, however, this was refused by Lord Justice Moses.
In accordance with the terms of consent order, the parties had 21 days to agree directions for the onward progress of the present claim.
However, I note that it is open to the respondents in SSHD V Raju and others to apply to the SC for permission to appeal. Accordingly, the defendent purposes that discussion of directions be postponed until it is known whether an application for permission will be made i.e. after 23rd july. when the time for making an application expires. The parties will then seek to agree directions for the onward conduct of the present proceedings within 21 days of this date.
Vish ...brother another twist in case now,ppl who won their cases in Upper Tribunal Got Letters In start of this Week,in Letters Upper Tribunal ask the Parties To attend the Case Management Review on 30th August...so there are Top Ten Firms Name who Are Representing PSW cases so Far will attend & SSHD in front of Judges..so They'll discuss the Effect of Khatel & others further cases...lets Hope it is Gud For us....& yes JR ppl also get the letters to File the Case on new Basis before 30th August.some of them already sent & they replied that Court will Put the Date of Hearing in 2months Time...means JR ppl will get the Appeal right like u...IN SHA ALLAH.....i dont know CMR will effect us & how long it gonna take...but it is gud at least that court is reviewing their decision....vishwen wrote:DEAR ALL,
I went to first tier tribunal on Monday 19/8/2013 for my appeal, regarding the new refusal sent but the ukba in march 2013. BUT THE PRESENTING OFFICER OF UKBA WAS NOT THERE, it was only the judge, my solicitor and me. my solicitor submit all the documents to the judge, and even told the judge, that how come my friends study with the same college, and was awarded after PSW was closed and been ranted visa, we showed all the evidence, including those who recently go visa a well, but the judge said she will give her decision within two weeks. my solicitor is confident we will win the case, as there was no CROSS EXAMINATION, I mean there was no challenge in the case. AND ALSO WE MENTIONED THAT THE CASE WAS ALREADY CHALLENGED IN THE HIGH COURT, AND THE PERMISSION FOR JUDICIAL REVIEW BEEN GRANTED. We told the judge, its all the mistakes by UKBA, and the judge was laughing. FINGERS CROSSED, THAT I WILL GETA POSITIVE DECISION.
