ILR Requirement for TIER1 GENERAL

Hello Forum,

Please advice I will be completing my 5 years on Tier1 General in May. And planning to apply for ILR.

I would like to know What is Home office ILR eligibility criteria for a person on TIER1 General, do i have to score points again, if yes How many Points ?

Is there a hard rule for TIER1 applicant that they have to compulsory earn £ 35000 Gross Per annum ?

My current earning is only £ 30000 PA Gross. Will this affect me ? Your Valuable advice will be appreciated.

Hi,

there are different eligibility criteria based on when your Tier 1 was approved initially, please go to point calculator for settlement on UKBA website and then assess your own points for your case..

No. Where did you get such an idea? Have you read the UKBA guidance for SET(O) applications? If not I would recommend that you do so, specifically see the previous earnings requirements.

Hi cs95tdg,

I had spoken to one of the Solicitor and he specifically asked me weather my pay is £35 PA

When i question why , i had been told Irrespective of other attributes, when it comes to the earnings it is a compulsory requirement that all the tier1 general applicants must earn £35 to be eligible for ILR.

Also i have one more question in my initial TIER1 General application i had claimed 10 points for my age in 2008 and did the same at the time of extension in 2011

Can i claim the same 10 points for the age now or i will be awarded 0 ?

Based on my knowledge, there is no specific requirement for T1 G to have a min. salary of 35K. All it says is you need to score certain points based on when your first EC was issued. Please see below link to calculate your points.

In one of the questions on the calculator it asks whether you want to claim points for your age. If you click the help link (opens in a pop up), it shows following.

"Points-based calculator - help
If you are in the UK and are applying to extend your stay you can score up to 20 points for your age. You should use your age at the date of your application for your first permission to stay as a Tier 1 (General) migrant, as a Highly Skilled Migrant, as a Writer, Composer or Artist or Self-Employed Lawyer. Please refer to the Tier 1 (General) policy guidance for details of the points that you can score for age.
If your first application was to the HSMP this will be the date that you applied for your HSMP approval letter, not the date that you applied for your leave."

This clearly tells that you can claim points based on your age when you first applied for Tier 1 (not your current age).

a highly skilled migrant
a writer, composer or artist
a self-employed lawyer
a Tier 1 (General) migrant.

If you first successfully applied under Tier 1 (General) on or after 19 July 2010, and you were not previously in one of the categories listed above, you will need to score a total of 80 points."[/color]

On how to Score points

[color=blue]"Unlike applications for permission to enter or remain in the UK under Tier 1 (General), you cannot score points for your English language ability or your maintenance (funds) when you apply for settlement.

You can only score points for your:

age;
qualifications;
earnings; and
UK experience.

These are called your 'attributes'.

Points will be awarded in the same way as for as your previous extension of stay under Tier 1 (General). If your circumstances have not changed, you will be awarded the same number of points for these attributes."[/color]

Also as seniors advised, refer to application and try to fill the form.
