Human right application

Post by razraz » Tue Jan 22, 2013 9:53 am

My friend is living in the uk for last 8 years. His visa expires on October this year. He has a 4 year old daughter and 2 year old son. Since his student visa can not be extended now can he apply for any human rights application on the basis that his kids were born here and can't go back to the parents origin country. Any humanitarian ground applications can be made?? Has anyone in this forum done so. If yes plz help ... Thx

the children are very young and therefore UKBA (and indeed the tribunal) is likely to say they can easily adapt to live in their parents' country of origin. Would suggest they seek legal advice.
