ILR stolen!!

Post by Mario_Ivan » Wed Jan 23, 2013 3:02 pm

Hi my passport was stolen last year which included my Indefinite Leave to Remain I was granted ILR in March 2009. I reported to the police but due the circumstances they only classed it as lost or gone missing, this happen in Nottingham.

I just got a new passport back last month now I want to get my ILR but I am confused with all this BRP and all that as I don't know what to get or what to apply there are so many forms.

I went to the UKBA office in Sheffield and I think he just said I need to fill in a NTL form but again is that all ? the form asking me all these things like if I am applying from scratch! , am I going to lose my ILR?

Cheers!

The advice that you were given is correct. The NTL (No Time Limit) form is used to transfer the NTL stamp to your new passport. You are not going to lose your ILR. I haven't read the form/guidance myself, but presume it would help you if you have a copy of your lost passport ILR stamp and or ILR grant approval letter with you.

Please read the form and guidance carefully to understand what you need to do.

See the UKBA reference below for further information: http://www.ukba.homeoffice.gov.uk/visas ... m-NTL-TOC/

If the residence permit in your old passport says that you have permission to settle permanently in the UK (called 'indefinite leave to remain'), you must make a 'no time limit' (NTL) application using form NTL. You can download this form and a detailed guide from the right side of this page.

Thank you I will have a read, I do not have the approval letter but do have an old and only copy of the stamp on the lost passport , I hope that will be enough.
Cheers!

PS: I was going to try to get my citizenship but because of this I haven't been able to , do I still need to get this replace first and then going for my citizenship? asking cus of the money costs issues!

Cheers!

You may find the following topic discussion useful to get the answer to your question on whether you can directly apply for citizenship. http://www.immigrationboards.com/viewto ... f0138132bc

It appears that it may be worth your while to request a SAR, as you do not have your ILR approval letter. http://www.ukba.homeoffice.gov.uk/navig ... onal-data/

Thank you again and that sounds promising ...as it would save me £220 that could go towards the citizenship.

I'll get on the SAR letter today.

thanks for all the helpful infos !!

Cheers!

Hi again I sent off for my SAR but it was rejected :? ....I explained on the form that I needed it for to replace my ILR as my passport containing the visa was stolen ... and that I did no have my approval letter.

I sent a copy of my new passport, a copy I had of my ILR visa , provisional driving license, NI , there reply was that "in my particular case , we note that you already have acceptable proof of your status in the United Kingdom, in the form of a visa issued to you at Sheffield.

The visa shows that you have residency in the United Kingdom.

We are satisfied that what you are asking is not a Subject Access Request under the Data Protection Act, and we are therefore rejecting it.

I also ticked on the form I wanted all data held on me.

does this mean I can apply for Citizenship or my ILR replacement ?? this is so confusing :( ...

Also I can't find my life in the UK certificate would I need it for citizenship?? as on the form you can you can tick that you met requirement for KOL for settlement but just below that it asks for Certificate number? i can assume that is for people who didn't had to take the test when they applied for ILR.
