My kind advice is
Go to Croydon if your case comes under discretion


Dear Kumar

Congrates !!!!!! two things I needs to know if you could let me know please:

1- You said you submitted 12 months pay Slips and 12 months Bank statements? is it requirement (12 months) or you just submitted at your own.

2- What do you mean by discretionary case?

I am Tier 2 (G).

1. I submitted on my own for 12 months. Its not mandatory
2. I was absent for more than 180 days in a single year under compassionate reason which comes under discretion case.

first of all congrats... my one question is when you came back after 250 days, were you came on the same visa or fresh visa?

I came in another Visa, but never had an gap between Visa's in 5 years.

@kumar. Congrats Kumar. I can imagine how much happy you were after winning the case under discreation. I am also on the same boat. Could you please share two things?
1.
what was your previous visa and your another visa when you came again?

2. Medical documents produced are related to you or something related to your relatives? the reason why I am aasking, i am going to produce medical docs of my own brother who was not well and I had to stay in India for sometime.

Give all the absence related documents
Apply only if you are ready to take the risk

Another help from forum,
My wife has visa till end of 2015 as Tier 2 ICT dependant and only eligible for settlement only in 2016.
Do I need to change her visa as settlement visa dependent now? or
She can continue till it expires and then switch over?
I am unable to find this related document in UKBA site, could u please give me a link which explains this.

[Kumar] - Both Visas were ICT Intra company transfer issued for same employee. I think if its same employee, it makes easier.

[Kumar] - Medical documents was for my father. You need to prove there was no one else there to look after than you. I had no one else.

You can get your SOC details in your PBS Certificate in Job type. You can use that in addition to your normal employer letter.

There is no such acceptable medical reasons and reason should be genuine.

Hello Mr. Kumar,

Did you get your ILR?

I am in a similar situation. The only difference is that I was on High skilled migrant visa my company paid my salary in the UK so I was still paying my taxes here. My visa expires on 7th June this year, and I would like to apply for an ILR. I am now married to a British Citizen, and I can apply for Spouse Visa, but in that case, I will have to wait for another 5 years to get my ILR. I am now confused what should be my next step. Any advice would be helpful.
