Hello,
I will apologize before hand but have to get this clear.
I have been speaking to Solicitor and get different advise from everyone.

My query again

My EC date is as below
Valid From : 09/04/08
Valid Until : 13/03/13

The date I entered UK - 15/04/08

My work permit document states,
Date of Issue - 13/03/08

Valid for 60 months from the date of entry.

I am still confused on the 28 day rule. I have just been advised by a friend who recently applied for ILR and he said that UKBA considers 90 day grace from date of expiry on EC and I can apply for my visa between 14 Feb - 13 March.

Some people are saying my 5 years start from 15th April, and I can only apply after 16th March, but by then my EC would have expired and they say I need to apply for an extension not ILR.

Can you please advise again for my piece of mind when can I apply for my ILR?. Thanks

About my kids, you have mentioned that my elder daugther will not be illegal or overstayer if I dont include her and also my younger one who has no visa at all will have no issues at all. Please confirm.

Dates are correct

My EC date is as below - This is on my Visa on the passport
Valid From : 09/04/08
Valid Until : 13/03/13

The date I entered UK - 15/04/08

My work permit letter which was issued by Home office has the
Date of Issue - 13/03/08. I guess on this basis, my EC has expiry date of 13/03/13.


Can I still apply between 14 Feb - 13 March based on the 90 day rule.

If my 5 years are counted from date of entry 15/04/08 then I will have to apply after 17th March but by then my visa would have expired.

Please advise.

I think you have a case of incorrect endorsement. Your visa date expiry should be 5 years from date of issue.

You need to get that fixed I think. Maybe time to get your company solicitors involved.
