Applying for parents - unique situation

Post by kissbang » Sat Jan 26, 2013 11:50 am

Hi,

I am working in UK on a Tier II WP & is valid till Sept 2013.

My parents are also there in UK now on a family visa sponsored by my sis who is a British citizen. Their 6 months visa is expiring this Feb 2013, and they are leaving back to home town few weeks before the expiry date.

I have a disability and am planning to undergo a planned surgery in March or April for which I would require my parents to help as I will be immobilized for a while.
My Doctor is also ready to write a letter to the visa authorities to establish i am having a surgery and would require my parents help.

Since they will be coming back in a short period after they have left UK need advise on the foll questions:
1) I was planning to apply for their visa as a general visitor & since my visa expires in Sept 2013, does that have a impact ?
2) Knowing that they are leaving UK in March and likely to come back on April , does that have a impact ?
3) Should i ask my sister instead to apply again for them a family visa ?
4) Will the mere fact of my disability, letter from doctor, salary slips should be enough to get their visa ?

Cheers!

1) No
2) Yes
3) If you wish to but they are still liable to be refused because it's not generally permitted to have more than six months per year.
4) No.

There return will amount to an arbitrary decision by the ECO but there is nothing in the rules that demands he make a positive decision in their favor.

THanks for the reply.

Are there any provisions for extending the current stay ?

Not for the circumstances you have described.
