Changing Tier 2 Visa ICT Short term to Tier 2 General

I am working in UK with Tier 2 visa from Jan 2013. Can I switch the visa to tier 2 general, so that I can switch to another job. And I am in Short term ICT.

My husband is on dependent visa. He is looking for a job in UK. If the switching is possible, will my husband's dependent also has to be changed?

No you are not eligible to switch to a Tier 2 general. You would only be eligible to switch from short term to long term with the same company while your current visa remains valid (if your role meets those requirements).

You would also be subject to a cooling off period of 12 months, whereby you would be ineligible for any Tier 2 visa for 12 months after the expiry of your short term visa.

Is there any other option for switching the company?

Is there any possibility of getting sponsership from any other company?

1.) No. Not under rules in effect since April 2011.

2.) Not for you.

3.) No.

The only option would be for your partner to get a job offer with sponsorship for a Tier 2. He would then have to apply for entry clearance on a Tier 2 general from your home country. Providing your visa is still valid if this were to take place, you could stay here. Alternatively, you could both leave the country at that point and you could apply to be his dependent. Either way, you would BOTH need to leave the country.

His job would need to meet the requirements for Tier 2 (NQF 6 and salary above 20,000 or in Soc Codes, whichever is higher). Additionally, his new employer would have to carry out the RLMT to ensure there is no one in the EU who could do his job.

Would the companies be ready to carry out the RLMT? I am just asking for the possibility if the job of my husband falls under Shortage occupations. is that common?

What is the process for us to apply for a H1 from UK? can we apply from UK itself or we need to travel back to home country?

Shortage occupations list. The company would have to carry out the RLMT if the job is not on this list.

Many companies are reluctant to sponsor people and support a Tier 2 visa as the process is excruciating (I have been going through the process for the last 9 months with my new employer and I am a shortage occupation worker). He would need to convince them of his value to their company.

I am not in software. Never heard of H1 (is that for the USA??). I am only familiar with applications for UK visas.

I have already told you what I know (or believe) to be true. If you don't feel secure going ahead with your own applications, you really should seek professional advice. Take my advice or leave it - your call.
