Help:Switching from Tier 1 PSW to Tier 2 General (Sponsor)

Hi guys

i am on Tier 1 PSW which expires on October 2013, i have been working as a web developer in a company (not in sponsors list) from last 13 months getting paid 21k p/a at the moment, i spoke with my employer they are OK to apply for Sponsorship but when they came to knew that they have to pay me 26k p/a (salary requirement as per section j of SOC) they are unlikely to do that which is mentioned in SOC.

Can i Apply for Tier 2 (general) even i don't satisfy SOC?

or can i work elsewhere on weekends to satisfy SOC to cover rest of the salary?

please advise me on this

1.) No. Well, you can apply but your application will be rejected.

2.) No. You could undertake supplementary work under Tier 2, but this would not count towards Tier 2 salary. Your employer should be paying you the going rate for your job. If they don't, they might be exploiting you.

Exploitation is too strong a word. The salary rates for the different SOC codes have been determined on a statistical basis from salary surveys.
Praveen golla
You still have plenty of time before your PSW visa expires. Look for a sponsor who is prepared to pay you the appropriate salary.

MIGHT. I did not say ARE. If the OP is being paid significantly below SOC (and therefor average from survey) rate and employer is unwilling to pay them more, the two could correlate. The poster is currently being paid 80% of Soc - it is up to OP to decide if that is exploitative or if any of their other practices are.

hence my suggestion to try to look for anothe job. Whatever the OP decides about exploitation is neither here nor there if the employer is not willing to pay him the SOC rate.

The word "exploitation" has a political connotation and I don't think it is appropriate in the present situation. We have a job market largely governed by supply and demand and the only legal requirement is to be paid the national minimum wage.

i spoke with HR again yesterday about the situation, she said she can change my role to hardware engineer in order to match SOC £20800 p/a.


is there a problem doing this ?
will it affect in future if i want to change sponsor?
