Hi,
Got a question for you guys, on December 21st 2011 I got a Criminal conviction and was ordered to do the community service.
I am now planning to extend my visa (LIMITED LEAVE TO REMAIN) as Entrepreneur.
So, I have a question:
Can I be refused or I Can’t be under new regulation as of 13th December 2012, which state:
Grounds on which entry clearance or leave to enter the United Kingdom should normally be refused:
(18A) within the 12 months preceding the date of the application, the person has been convicted of or admitted an offence for which they received a non-custodial sentence or other out of court disposal that is recorded on their criminal record;
Grounds on which leave to remain and variation of leave to enter or remain in the United Kingdom are to be refused:
(1C) where the person is seeking indefinite leave to enter or remain: (iv) they have, within the 24 months preceding the date of the application, been convicted of or admitted an offence for which they have received a non-custodial sentence or other out of court disposal that is recorded on their criminal record.
None of the above seems to apply to Limited Leave to Enter, as one of the paragraphs talks about Leave to Enter and another about Indefinite Leave to Remain.
Which of the paragraph shall apply to my application for Limited Leave to Remain?
Any advice is much appreciated.
