Guru can you please explain me, as I am not working full time. I am looking for a full time job. With out full time job, can I support her visa application having bank statements with balance up to £6000.

Savings of £6000 should suffice. You should be claiming JSA, HB and CTB if you are unemployed.

Thanks Guru for your reply. As I have recently finished my studies. I have some saving with me to prove that I can support my wife's application for FLR or ILR with out depending on benefits.

As you have ILR, then so long as the benefits award only a single person amount, there shouldn't be an issue.

Many thanks Guru. Can I apply for my citizenship certificate and British passport straight way after my ILR. As I have been living in UK for more then ten years.

You must have ILR for 12 months unless you're the spouse or civil partner of a British Citizen.

I am still waiting for my ILR. After my ILR I am plaining to apply my wife's visa at PEO using both FLR (M) and SET (M) application forms. The application fees are different for both application forms. To book an appointment which application form I should use.

Can anyone or Guru help with my case please.
I came to UK as student in 2003 for three and half years visa to pursue Ph. D. Instead of doing Ph. D. I took admission in Diploma (business studies) and then BBA. In Oct 2006 I had applied for extension of my student visa and on 01/05/2007 my application was refused. I wasn't given chance to appeal against the decision but was asked to give statement for the reasons to be in UK. I had given my statement after four days of refusal letter. I August 2007 HO closed the college where I was studying. I had informed HO about my intentions to continue my studies in march 2008 after having offer for Ph. D. course again. The HO acknowledge the receipt of this letter. In June 2008 I had started full time university education and had applied for FLR(S) on 10/07/2008. The HO acknowledged my application on 11/07/2008 and then further confirmed on 23/07/2008 that application was valid. On 19/02/2010 was given extension of my student visa. The later application were all in time and Tier 4 student was issued. Now I have Tier 4 doctorate extension till June 2014.
On 09/08/2013 I had applied for ILR and my application was refused on 05/12/2013. The reason given is that I didn't have continuous 10 years lawful residence in UK. The caseworker consider that my leave was broken at the refusal on 01/05/2007 till 19/02/2011 when I was given further leave as a student.

Why were you not given any appeal rights in 01/05/2007? What was the reason for refusal? Did you still have valid leave? Did you ever get a response after sending the letter in? When did the leave you had in 2007 expire?

I came to UK on June 2003 and started Diploma in Feb 2004 and then continued BBA. Secretary of state wasn't satisfied that I had spent more than two years on short courses and broken off long course before completion.

I still have Tier 4 Doctorate extension till June 2014. I had letters confirming the receipt of letters sent after refusal. My first visa was from June 2003 till Nov. 2006. I have applied for extension in Oct 2006 and my application was refused on 1/05/2007. Five days after refusal I have sent them my statement. In Aug. 2007 college was closed by HO. Then I started to look around for admission in Ph. D. In march 2008 I got offer letter for admission. Then I informed HO about my intention to continue my studies.

Sending letters to ukba does not grant or extend your leave. You were an overstayer after you were refused. You remained an overstayer until you were granted leave in 2011.

My application for ILR (FRR-FP) is pending in court. I have almost used my appeal rights. The HO is considering a gap (July 2006 to Feb 2010) in my long residence. Since Feb 2010 I have been lawful in the UK. I can extend my leave for further two years by obtaining the graduate entrepreneur visa. The university is willing to sponsor me for the work permit. I would again complete ten years lawful in Feb 2020. Can I get ILR by completing ten years of lawful residence in Feb 2020.
