Confusion on Dependent ILR

Post by kunalgujar » Thu Feb 07, 2013 5:57 pm

Hello all

I entered the UK on work permit on the 10 Feb 2008 and I switched to Tier 1 General after a year and a half.
I will finish my 5 years continuous period in the UK on the 10 Feb 2013 and can apply for my ILR. My current visa Tier 1 General is valid until May 2014.

Got married recently and my wife entered the UK on the 9th Jan 2013.

Please could you clarify the below so I am sure I am doing the right things:
1. As my wife’s Initial application for leave as PBS dependant made after 08-Jul-12, she will be eligible for settlement only after completing "5 year probationary period as a dependant of the principal migrant". What proofs should we collect for this 5 years duration so we can prove that we were living together. I am trying to get hold of council tax, NHS medical certificate and voter card for the moment. Please suggest anything else we should gather.
2. So in the above case my wife cannot apply for her ILR at the moment. Her current Tier 1 General Dependent Visa expires on May 2014 and she will just finish a year and a half in the UK till that time. So this will expire before she finishes 5 years in the UK, so I should be extending her visa as a PBS Tier 1 dependent for further 3 years and then again. Please confirm.
3. By the time my wife finishes 5 years in the UK, I will already have a ILR and also possibly can apply for citizenship. So in case I apply for citizenship after 6 years in the UK, will my wife be eligible for citizenship after her 5 years or she will have to apply first for ILR and then after 6 years she can apply for citizenship.

Please advise and clear my confusion. Thanking all for this awesome site.

Best Regards, Kunal

Read pbs dependent from my 'useful links'below.

Set up a bank account and some bills in joint names for Cohab docs.
Please do not send me PM if I haven't sent you one yet.
